After nearly 30 years practicing employment law, I believe that I can sniff out a sham dismissal process fairly quickly.
The usual first sign is the handling of any suspension.
Given that we ‘miscreants’ were suspended at a time when the country was firmly in lockdown and the Railway closed, one might legitimately ask what suspension would achieve. I certainly did.
To reply on the ACAS Code as MyHR ‘independent’ investigator Ashton did, and then not be able to explain that seemed to me laughable – but read the e-mails and judge for yourselves.
